Terms of Use for Bus Ticket Purchase
1. General
1.1. Obilet Bilişim Sistemleri A.Ş. ("Obilet") provides a platform for the sale of bus, plane and ferry tickets through the www.obilet.com domain website (“Website”) and the Obilet mobile application (""Mobile Application""). The Website and the Mobile Application will be referred to together as the “Platform” in the document “Terms of Use and Rules of Service for the Purchase of these Bus Tickets” ("Bus Terms of Use").
1.2. Please read this page when you visit Obilet or want to buy tickets. From the moment of your first visit to Obilet, you fully understand and fully accept the considerations written below, which contain important information about visiting and/or using the Platform, as an integral whole.
1.3. These Bus Terms of Use are an integral part of the other explanations, policies and rules contained on the Platform.
2. Parties and Subject
2.1. These Bus Terms of Use apply to everyone who visits the Platform, buys a ticket and/or becomes a member. Within the scope of the Bus Terms of Use, the expression “User” means all individuals who purchase a Bus ticket as a member of the Platform (“Member”) or who purchase a Bus ticket only by visiting the Platform (“Visitor”).
2.2. The owner of the platform is the company Obilet Bilişim Sistemleri A.Ş. residng at “Sultan Selim Mah. Yunus Emre Cad. Topçu İş Merk. No:1/11 Kat: 3 Kağıthane/Istanbul”. The platform services offered through the platform are provided by Obilet. In this context, “Service" means the process of purchasing tickets for users via Obilet.
2.3. The transportation service for Bus tickets offered for sale on the Platform is clearly stated in the section where the relevant ticket is purchased on the Platform, and Obilet has no responsibility for the provision of this service. Obilet, which mediates the establishment of a distance contract within the scope of the Law No. 6502 on Consumer Protection and the Law No. 6563 on Electronic Commerce Regulation and has the title of Intermediary Service Provider, has no obligation regarding the opening hours and/or similar content provided by transportation companies.
2.4. These Bus Terms of Use are contractual and the subject of the contract is the sale of Bus passenger transportation tickets. The ticket's sales price consists of the payment method, departure terminal, arrival terminal, trip date, departure time, information at the time of order completion and is also sent to the Users' e-mail address. 3. Provisions
3.1. Obilet has the right to change the information, forms, content of any kind and these Bus Terms of Use at any time, as well as without any notice, contained or received on the Platform.
3.2. All content created by Obilet, including but not limited to the design of the Platform, images, html code, as well as brands and logos belong to Obilet. Users may not use, share, distribute, display, reproduce, perform works derived from Obilet's products subject to intellectual and/or industrial property rights.
3.3. Obilet may record and store the records specified in the relevant legislation within the legal period in respect of any transactions performed by Users in order to comply with the obligations imposed on it in accordance with other applicable legislation, especially the Law No. 5651 on the Regulation of Broadcasts Made on the Internet and the Fight against Crimes Committed Through These Publications. These processes may also include the time and duration of the visit, the pages viewed, and information about the site visited before arriving on the Platform. This information is only used to measure the activity of the Platform and to generate ideas to improve the Platform. The platform is accessible to all Users.
3.4. Users agree and undertake that they will not reproduce, copy, distribute, process any content, including electronic text, audio-visual images, video clips, files, databases, catalogs and lists contained on the Platform, and that they will not enter into direct and/or indirect competition with Obilet, either by these actions or by other means. In this context, it is forbidden to copy, reproduce, transmit, and process the contents and the interface without Obilet's written consent and to display them on other websites and/or media. All the content accessed and/or displayed on the Platform cannot be used and viewed in any environment, especially on the internet, by third parties without Obilet's prior and written consent; otherwise, it will constitute illegal use.
3.5. It is considered in accordance with the law that the database in which the content accessed and/or viewed through the platform is stored is accessed by third parties only for the purpose of viewing the relevant content and/or as permitted and within the scope of Obilet. Accesses other than this are illegal. All or some of the information contained in the database and the database may not be copied, transferred to other databases, and made available to third parties from these databases without the prior and written consent of Obilet.
3.6. It is forbidden to intensively pull information from the database in order to obtain content accessed and/or viewed through the platform. Obilet may use its legal rights in order to punish people who do not comply with this prohibition in accordance with the applicable legislation for committing the act of “unauthorized access to the information system”.
3.7. Obilet does not make any guarantees about the service it provides. The platform and its contents are presented on the basis of ""as it is". Obilet is not responsible for any damage or loss caused by the failure, error, cancellation or delay of any trip, communication interruption, computer virus. Users agree in advance that Obilet reserves the right to block their entry and carry out any sanctions, including but not limited to, if they violate the rules and obligations set out in these Bus Terms of Use.
3.8. Obilet and its partners, employees or content providers, together with Obilet, cannot be held responsible for possible errors and unintentional omissions, defects or lack of information that may occur on the Platform, regardless of the reason and duration, damage that may occur due to interruption or delay suffered by Users. All these organizations or persons are not liable for claims of damages and losses of third parties, punitive damages or indirect damages.
3.9. Obilet may provide links and/or redirects to other internet sites through the Platform. Obilet may post advertisements and/or application forms for various services of third parties with which it is contracted, and direct Users to the sites of advertisers or third parties through these forms and ads. The presence of these links does not indicate that the content of other sites and pages is controlled by Obilet. Obilet is not responsible for the privacy practices, content of other websites accessed through this link, or the privacy policies and practices of third parties. Obilet has no responsibility for the content that can be accessed through these links, and Obilet is not responsible for any damage caused by transactions on other websites accessed. When users access other internet sites using these links, they acknowledge in advance that they are responsible.
3.10. All responsibility for the actions taken by users on the Platform belongs to the relevant User. Membership and/or purchases may be viewed by third parties using this computer, especially in cases where Users use a public computer, but not limited to. Users should pay maximum attention to this situation.
3.11. Membership to the Platform is for personal use. Members have the option to receive more information about the services and to opt out of membership. Members can change or update their membership preferences or membership information at any time. Members can also close their membership accounts at any time.
3.12. The Bus Terms of Use and other texts contained in the Platform are automatically cancelled by the closure of the Platform by Obilet for whatever reason. So far, Obilet is authorized to change its business, commercial partnership and domain name as well as carry out the same activity through another domain name, and these changes will not have any effect on the Bus Terms of Use.
4. General Rules
4.1. The User accepts and undertakes that s/he is responsible for the content and accuracy of the passenger information entered on the Platform, that changes cannot be made after entering the information into the system, and that s/he is fully responsible in case of any damage caused by this.
4.2. The User accepts and undertakes that Obilet will not be responsible for any disputes, damages and/or claims that may arise between the transport companies and the User in the services of Obilet, and that the only communication channel is the actual provider of the relevant service.
4.3. The User agrees and undertakes that Obilet makes no commitment that the content received from bus companies and/or intermediary institutions will be accurate or complete, and that Obilet is not responsible for any damage caused by disconnection from internet infrastructure and telecommunications provider companies or any communication interruption that may occur.
4.4. The User accepts and undertakes that Obilet takes maximum care about the accuracy of the information received from suppliers and/or brokerage firms and announced on the Platform, but Obilet cannot be held responsible for the fact that the service received or requested does not show the specified quality and availability of space.
4.5. The User agrees and undertakes that the Service is organized individually or under the control of the relevant bus companies and/or intermediary institutions, and that the rules and conditions of the relevant transport company apply to declarations related to the content in the Obilet.
4.6. Obilet is at intermediary between the User and the bus company in the services it provides. The User accepts and undertakes that s/he cannot be held responsible for any problems that may occur in the services mediated by Obilet. In addition, Obilet or its contracted agents will not be held responsible if the Bus ticket cannot be operated due to the rules and restrictions of the transportation company that purchased the Bus ticket in the application.
4.7. The User accepts and undertakes that Obilet will not be responsible for any political events, strikes and public movements, minimum number of passengers, extra booking, natural events that will occur at a level that will affect the activity of the expedition site, problems that may arise due to reasons other than its will, such as lack of availability of the location and technical failures that may interfere with the trip on tickets purchased by Obilet through sales channels.
4.8. The User agrees and undertakes that Obilet will not be liable for force majeure, extraordinary circumstances, accidents and similar events that may occur before/after the trip or during the expedition of the ticket that Obilet receives through sales channels.
4.9. The User must correctly enter her/his name, phone number, TR identification number, e-mail address, credit or debit card number, expiration date of the card and the information requested through the Platform when making a purchase on the Platform. The User agrees and undertakes that Obilet will not be responsible for any disruption that may occur due to the fact that this information is not provided correctly or in full. Obilet will send an electronic message to the contact details entered by the User at the time of purchase to inform the User about the service provided.
4.10. Payments will be made by credit or debit card for all purchases to be made through Obilet. The User agrees and undertakes that the debit or credit card used for payment must be a member of the 3D Secure system. 3D Secure declares that the responsibility for transactions performed with this system is solely on the User, as it ensures that transactions are made with the full verification method through its own system, so it cannot object to expenses for payments made on the Platform. The User agrees that Obilet is not responsible for any glitches that may occur due to 3D Secure.
4.11. A reservation made on the Platform or a purchased service cannot be transferred to someone else and a name change cannot be made.
4.12. If the User encounters a refund situation after the services s/he has purchased on the Platform, s/he agrees and undertakes that the fee to be refunded will be determined in accordance with the terms of the transport company and/or the brokerage firm. This process accepts and undertakes that the refund to be determined as a result of this process will be made to the credit or debit card used when purchasing the service, if necessary, to the account number specified by the user.
4.13. The User agrees and undertakes that s/he is faithful to the conditions of the bus company and/or the intermediary company for all services purchased through the Platform, that the information updated by the transport company applies if the transport company changes these conditions, that different practices and fee penalties determined by all airlines may occur for cancellation/refund and change operations.
5. Carrier Company Services
5.1. Obilet provides platform services for the sale of tickets for the Bus and passenger transportation service provided by carrier companies through the Platform. In this context, Obilet is not responsible for the failure of the carrier companies to provide the services they are committed to providing and/or for the problems caused by the carrier companies. Similarly, in accordance with the ticket sales policies of the carrier companies and the contracts concluded, Obilet does not refund the cost of a ticket sold and the cost of service if it was received. 5.2. The refunds of the tickets that can be refunded for payments made through Obilet sales channels are made only to the card used in ticket purchase transactions. In case the card used for payment has expired or has been cancelled;
- If the cardholder uses another card belonging to the same bank, the refund is made to the cardholder's account.
- If the cardholder has stopped working with the bank, s/he should contact the Call Centre with the official letter s/he received from the bank.
6. Protection of Personal Data and Privacy
6.1. Obilet undertakes to take all necessary measures to keep personal data and customer information confidential and to maintain them in accordance with the applicable legislation. To learn more about personal data, please read the Disclosure Text on the Protection of Personal Data.
6.2. Obilet may share visiting, shopping and similar necessary information with third parties if information is requested by the competent administrative and/or judicial authorities in accordance with the rules of law and procedure in accordance with an investigation or prosecution conducted in accordance with the applicable legislation, and/or if it is deemed necessary to provide information regarding the protection of the safety of Visitors, if it is necessary to comply with the requirements arising from the applicable legislation.
7. General Provisions
7.1. The law of the Republic of Turkey will be applied in the application, interpretation of these Bus Terms of Use and in the management of legal relations arising under these Terms of Use. Istanbul (Central) Courts and Enforcement Offices are authorized in the event of any dispute related with or arising out of these Bus Terms of Use.
7.2. In all cases that are considered force majeure by law, Obilet is not legally responsible for late performance and/or non-performance of any of its obligations arising from the Bus Terms of Use. These and similar situations, from the point of view of Obilet, will not be considered a delay, non-performance or default, or Obilet will not be liable to compensate Users for any damages for these situations. The term force majeure will be interpreted as events that Obilet and / or the carrier companies that will provide transportation services in accordance with the purchased ticket cannot prevent, except for their reasonable control and despite taking the necessary care. In this context, but not limited to, natural disaster, riot, war, strikes, epidemics, communication problems, infrastructure and internet failures and/or surges, power outages and bad weather conditions and/or administrative decisions are considered within the scope of the force majeure, as well.
7.3. Notifications to be made to Users if they purchase tickets will be made via the e-mail addresses and/or phone numbers that they enter in the relevant sections of the Platform. Obilet will not be responsible for any failure to notify Visitors and/or Members due to incorrect contact information.
7.4. Users make their preferences regarding commercial electronic message notifications related to being contacted by Obilet when they become a member of the Platform and/or purchase tickets. Members can change their communication preferences at any time from the relevant section of the Platform. Visitors who use the Platform without being a member can also always send their communication preferences to Obilet by e-mail, phone or similar methods.
7.5. The parties agree that the books and records of the parties, computer records, confirmed fax messages, emails are valid and evidential in case of disputes that may arise from the Bus Terms of Use.
7.6. It cannot be interpreted that Obilet has waived its right if it has never exercised and/or late exercised its rights arising from these Bus Terms of Use and/or applicable legislation.
8. Effect and Communication
8.1. These Terms of Use are accepted by Obilet and by the User upon purchase of the Bus ticket. According to Article 20 of the Regulation on Distance Contracts entered into force within the framework of the Law on Consumer Protection No. 6502, Obilet is a company that mediates the establishment of a distance contract on behalf of the seller or provider by using or use of remote communication tools within the framework of the system it has created. According to the Regulation on Distance Contracts, the seller and providers are directly responsible to the consumer for the provision of transportation and accommodation services and the provision of the necessary information.
8.2. Within this framework, the User agrees in advance that the rules and conditions established by the organization providing transportation services apply in terms of tickets purchased through the Platform.
9. Settlement of Disputes and Legal Obligations
9.1. The law of the Republic of Türkiye will be applied in the application, interpretation of these Terms of Use and in the management of legal relations arising under these Terms of Use. Istanbul (Central) Courts and Enforcement Agencies are authorized in the event of any dispute arising out of or arising out of these Terms of Use.
9.2.In all cases that are considered force majeure by law, Obilet is not legally responsible for late performance and/or non-performance of any of its obligations arising from the Bus Terms of Use.
